    Get Ready, Canada: Saks Fifth Avenue Is Coming Your Way

    Saks Fifth Avenue announced Monday that it has agreed to let Hudson's Bay Company ? the Toronto-based firm that owns Lord & Taylor and Hudson's Bay ? buy the company for $2.4 billion. This means one of America's most famous department-store chains is now owned by a Canadian business, and it also means Saks will soon expand into the Great White North.

    The chain's new owners plan to build Saks Fifth Avenue locations and its Off Fifth outlet stores throughout Canada, according to Dealbook. These stores will join Saks's other international outposts in Mexico, Dubai, Bahrain, and Kazakhstan.

    "We are excited about what this opportunity and being part of a much larger enterprise can mean for the future of the Saks Fifth Avenue brand," said Saks CEO Steven Sadove in a statement.

    Technically, Saks still has a 40-day "go-shop" period, during which it can still entertain other offers before officially becoming part of Hudson's Bay. Earlier bidders for the retailer included Kohlberg Kravis Roberts, a private equity firm that might have merged Saks with Neiman Marcus, and the Qatar Investment Authority, which owns stakes in Tiffany & Co. and LVMH, among other holdings.

    'Yellow Cards' in College Football Is a Great, Out-of-the-Box Idea

    Imagine, for a moment, that a safety just collided with a tight end stretching out for an overthrown ball. The tight end crumbles to the ground, causing a synchronized gasp to echo throughout the stadium, and yellow flags paint the field.

    The officials quickly meet and conclude?well, speculate feels more appropriate?that the safety targeted the defenseless player who still remains down on the turf.?At that moment, the defender knows exactly what?s coming. His body language speaks volumes.

    His arms fall limp to his sides; his head bows in disgust. The lead official approaches, reaching into his pocket as he maneuvers toward the guilty player, and he reveals a yellow card.?

    He lifts it to the sky and boos rain down.

    The 15-yard penalty is assessed as the tight end is helped to the sideline?returning a few plays later. The safety stays in the game knowing the room for error is now none.

    ?It?s a total hypothetical,??said Northwestern head coach?Pat Fitzgerald, when asked about a solution he brought up at Big Ten Media Days. ?I?d rather warn the player, telling him this is not the hit we want in football.?

    Hypothetical or not, he?s onto something. And if yellow cards aren?t the answer, at least the possibility of a new, bold idea is being discussed.

    The new targeting rule?in which players can be ejected immediately for hitting defenseless opponents above the shoulders?was the talk of the conference media day circuit. At some point, each coach in the country was asked to provide their input.

    While most did little to offer up soundbites beyond ?whatever is in the best interest of the kids? or ?we?ll see,? a few took notable stances.

    Stanford head coach David Shaw was one of the few to strongly defend it, according to NFL.com?s Dan Greenspan, saying, ?College football needs the rule, just like the NFL needs the rule.?

    On the opposite end of the reaction spectrum, Nebraska?s Bo Pelini and Washington State?s Mike Leach stated their concerns. Each coach expressed his displeasure, especially when pressed on the possibility of Jadeveon Clowney?s hit on Vincent Smith suddenly being worthy of an ejection.

    Leach, via Howie Stalwick of Scout.com, offered up his thoughts. Hey, at least he said "with all due respect" first.

    "Clowney?s hit ? with all due respect to the officials, you?ve got old guys (officials) out there with bifocals on trying to identify in a split second who lowered their head first."

    Controversy is brewing?despite the good intentions?well before the first questionable call is made and game-changing ejection takes place. Many are bracing for the absolute worst, while others see this as a necessary move.

    Then there is Fitzgerald, a former All-American linebacker sporting a football pedigree matched by few, tossing around a soccer solution for one of his game?s biggest problems.?

    ?Our young men have an opportunity to play 48 games and maybe a few more if they?re lucky,? Fitzgerald said. ?Taking away one game can be significant.?

    Put aside the soccer disdain if such contempt exists, and for many of you, it likely does.?

    This is not an attempt to somehow transform football into futbol but rather to use its guidelines to discourage certain behavior. That?s the purpose of a yellow card. It serves as one free pass before the individual?and team?suffers the consequences, and it discourages repeating such actions.

    ?Say the hit wasn?t malicious and there wasn?t an intent to injure, but, by definition, it was a high hit,? Fitzgerald said on providing warnings for targeting. ?The next time you do it for the rest of the season, you?re going to lose a game.?

    Fitzgerald didn?t go on to outline a full campaign for a yellow card movement, but the intent behind this idea is clear: Provide a small window of error for players (and officials) before minutes are taken away.

    Let?s not stop there. Taking his brainstorm one step further, a yellow card could come with a 15-yard penalty and an automatic review following the game.

    If the hit in question is deemed suspension-worthy after officials watch various replays?similar to the review process utilized a season ago?a conference has the power to suspend the player the following game.

    If it is a questionable call, the player will be on notice for the rest of the season. Any yellow card received from that point on will be an immediate suspension for the player.

    Teams can also be fined if a certain threshold of yellow cards is reached.?The fine, in itself, sends a message. Coaches must teach their players the appropriate way to tackle, or they?ll have an unpleasant sit-down with their superiors. This movement starts from the very top.

    For the officials, the yellow cards could provide some valuable leeway. With so much gray area on what constitutes targeting, a warning?along with ample time to review postgame?could soften the pressure off those now tasked with making an impossible call in real-time.

    This, of course, is all a hypothetical solution to an assumed problem.

    It?s assumed that the new targeting rule will fail, that ejections will be rampant and rulings will be inconsistent. Perhaps this won?t be the case, although the rushed evaluation isn?t the appropriate way to tackle a complex issue.?

    Adding yellow cards?or blue cards, or an orange towel or whatever would serve as a warning sign?is merely another solution to throw on the top of a growing pile. It would provide a philosophical change, but all out-of-the-box ideas are welcome.

    The issue of player safety will only become more prominent, and ensuring that these safety guidelines are maintained will generate both controversy and discussions regarding ways to improve them.

    Fitzgerald?s open brainstorm may not be the ultimate solution, but it is a simple (yet somehow radical) idea to mull over as the debut of the new targeting rule approaches.

    If an immediate ejection isn?t the answer,?it's back to the drawing board.

    Mali holds 1st poll since coup; rebels warn voters

    KIDAL, Mali (AP) ? The U.N. peacekeepers deployed here did their best to paint over the independence slogans emblazoned on the concrete wall surrounding one of the main polling stations in this contested city, the epicenter of last year's rebellion against Malian rule. The white paint they used wasn't thick enough though, and the slogans were still legible to the voters who lined up outside.

    "Mali is the cause of our problems," said one. "Why should we remain colonized when we have all we need to be independent?" said another.

    Only a timid trickle of residents in Kidal, a city at the feet of the Sahara desert, showed up to vote Sunday in Mali's first presidential election since last year's coup and subsequent rebellion, and as polls closed numerous precincts turned in ballot boxes that didn't have so much as a single vote.

    Those voting in Kidal are among a minority of people in this vast province, spanning an area the size of Iowa, who recognize Mali as their legitimate ruler. And even those who chose to come with the intention of voting were often unable to cast their ballots because of the various technical glitches which have plagued the hastily-organized poll.

    The vote is meant to be a new beginning for a country that was once an example of democracy in West Africa. Officials fear, however, that the legitimacy of the election will be undermined by low voter turnout, technical lapses that prevented people from voting, and the contested status of Kidal where the rebels remain in control of numerous government buildings. If the results are not accepted, they fear it could fuel a future rebellion.

    Mohamed Ag Sidi squatted on the ground and tried to find his name on the voter list outside one polling booth in Kidal. The metallic door on which the list had been posted was torn down overnight by the punishing desert wind, and election officials had put the torn pieces of paper on the floor, held in place by rocks. In the rush to hold the election, the government printed voter ID cards with only the name of the voter and not the address of the polling station where they're expected to vote.

    A 64-year-old woman arrived well before the opening time, and unlike many others, found her name on the list. She was assigned to Polling Station No. 3. But after traipsing across the complex, she failed to find No. 3, only No. 2 and No. 4.

    "I know only of the nation of Mali, and that's why I came to vote," said the woman, Fatina Walet Alitine, a member of the Tuareg ethnic group, whose members have led four rebellions against the state in the past half-century.

    She pointed to a group of young Tuareg men who were loitering inside the grounds of the polling station, all members of the National Movement for the Liberation of the Azawad, or NMLA, the separatist movement that launched the most recent rebellion last year, seizing and briefly holding a France-sized chunk of northern Mali, which they declared was the new Tuareg nation of Azawad.

    "They told me that if I vote, they'll break my arms," she said. "So I said, 'Well, then you better break my arms.'"

    The Tuareg rebellion set off a chain reaction of events which plunged this once stable country into ruin. Soldiers in the faraway capital, angered by the government's inept handling of the insurgency in the north, mutinied, overthrowing the democratically elected president in March of 2012. The country has been without a legitimate leader since then, and the election Sunday is supposed to return the nation to constitutional rule.

    A total of 6.8 million people registered to vote in this nation of nearly 15 million. They are choosing from 28 candidates on the ballot, including veteran politician Ibrahim Boubacar Keita, known by his initials IBK, a former prime minister as well as the ex-president of the country's parliament, as well as Soumaila Cisse, an ex-finance minister and Dramane Dembele, the candidate of the country's largest political party.

    In the southern half of the country including in the capital, voter turnout appeared to be far higher, reflecting the north-south split which has bedeviled Mali since its independence from France 53 years ago. It was then that the Tuaregs, the lighter-skinned nomads of the north, petitioned their colonial ruler, asking to be granted their own territory separate from the rest of Mali. They pointed to the linguistic, cultural and racial differences which have long made them distinct from the black ethnicities that make up the Malian majority, said Ambeiry Ag Rhissa, the acting head of the NMLA rebel movement in Kidal.

    "We had nothing in common with Bamako," he said, referring to Mali's capital located 950 miles (1,500 kilometers) away to the south. "And we have had nothing but problems since then."

    As the late afternoon dragged on and it became apparent that turnout was dismal, officials showed up and began pressuring poll workers sitting next to empty ballot boxes to artificially inflate turnout, said several witnesses.

    In one school consisting of cement cubes for classrooms, election workers had fallen asleep, splayed on the bunks, after waiting all day for voters who never showed. In Polling Station No. 003, out of 101 registered voters, zero had shown up. A few doors down in No. 006, the president of the polling station Hamidou Djiga had started filling in the final tally sheet, circling in "0," and "0," and "0'' for the number of votes per candidate after not a single one of the 234 voters had cast a ballot. "Not one showed up," he said. "Not even a single 'Bonjour.'"

    Poll worker Abdoulaye Mohamed was sitting in Polling Station No. 27, where there were zero votes for 467 registered voters, when the region's prefect arrived, he and other witnesses said.

    "I was there when the prefect came in and told us to fill in 10 ballots ourselves and put it in the ballot box," said Mohamed, representative of the country's election commission. "He didn't tell us which candidate to vote for, so I think he was just embarrassed at having precincts with zero voters."

    Whitecaps lose second straight match as Hoppenot leads Union to 1-0 win

    The Vancouver Whitecaps almost pulled off a miracle Saturday.

    Or at least a scoreless draw.

    But in the end, they could not make up for being shorthanded most of the game and fell 1-0 to the Philadelphia Union, suffering their first home loss of the Major League Soccer season.

    Second-half substitute Antoine Hoppenot?s goal in the 85th minute proved to be the difference. The Whitecaps gave a valiant, if not sensational, effort as they were forced to play with 10 men after midfielder Jun Marques Davidson received a red card for head-butting Keon Daniel in the back in the eighth minute.

    The Whitecaps (9-7-5), who were unbeaten in 10 previous home games, recorded their second consecutive loss.

    The Whitecaps were forced to play with 10 men after midfielder Jun Marques Davidson received a red card for head-butting Keon Daniel in the back. The incident resulted after Keon kicked the ball while Davidson was on top of it after a whistle.

    The Union player earned a yellow card for the infraction and had turned and started to walk away following a face-to-face confrontation with Davidson when the Whitecap decided to seek some revenge.

    ?It?s just what happened,? said Davidson, a defensive specialist, finding himself under media scrutiny for a rare time in his two-season Vancouver tenure. ?I reacted wrong and, for all of it, I just want to apologize to all the players.?

    He also apologized to fans, adding the miscue was out of character for him.

    The Whitecaps still managed to match Philadelphia?s five shots on target, while directing 14 on goal, down slightly from the Union?s 16.

    Hoppenot scored off a Philadelphia counter-attack moments after Union goalkeeper Zac MacMath had robbed Whitecaps striker Camilo at the other end of the pitch.

    ?Obviously, the red card changed the game pretty early on,? said MacMath. ?But I thought the team played really well and did well being patient throughout the game and waiting to get that final goal.?

    MacMath earned his seventh shutout of the season in one of his busier games.

    ?The first half wasn?t too busy,? said MacMath, who was credited with five saves. ?But the second half, especially with them pressing, after they gave up the goal, it was a busy game for me and a busy game for the team in general.?

    The setback deprived Vancouver goalkeeper Brad Knighton of a chance to beat his former squad after being released by Philadelphia following the 2010 season and forced to play a campaign in a lower-tier circuit in 2011. Knighton made some timely saves, but now, after his second consecutive loss, risks losing his starter spot to former Danish Superliga star David Ousted, who was signed in June.

    ?We?ve made this place a fortress over the last six months, and it?s a tough one,? said Knighton, who recorded four saves. ?I felt like we had our chances today, and we just didn?t take them.?

    The Whitecaps were fortunate not to lose Knighton after he and Philadelphia captain Jack McInernerey, a former teammate and close friend, knocked heads in the 24th minute.

    But the Whitecaps would not be so lucky when it came to converting scoring chances or having other players remain healthy. Vancouver lost striker Kenny Miller to a groin injury just two minutes into the second half and central defender Brad Rusin late in the game.

    The contest ultimately turned after Rusin left in the 81st minute after he was hurt blocking a shot. He was replaced by Carlyle Mitchell, who was victimized on Philadelphia?s goal.

    ?It?s hard to change the centre back like we had to at that moment,? said Rennie.

    Hoppenot scored as Mitchell gave the ball away, fell and then could not get up in time to prevent Aaron Wheeler from sending a short pass to him. Mitchell said he blocked the first pass but wasn?t able to prevent the Union from continuing on goal.

    Rennie stuck with the same lineup, but will be forced to make changes in the next game Aug. 3 at Portland. Davidson received an automatic one-game suspension, and could face further discipline from the league. Fellow midfielder Gershon Koffie will also serve a one-game suspension after taking his fifth yellow card of the season as he fell in the Philly box and tried to draw a foul.

    Miller and Rusin?s injuries also raise questions about their availability, and Knighton could be replaced in favour of the higher-paid Ousted.

    ?There?s other players ready to play that could play if they?re not in the starting lineup,? said Rennie. ?And, it?s up to them to get in the lineup and play well and take their chances.?

    How the magic of animated GIFs could solve the web&#39;s video ...

    It?s 2013, and yet we?re still relying primarily on static images for finding videos on the web.

    For all the great strides we?ve made in online video over the years ? the rise of HD content, more efficient codecs, and so on ? the act of browsing a web page or app to choose a video feels practically archaic. But there may be an answer inspired by the unlikeliest of mediums: animated GIFs.

    Redux, maker of the popular video discovery app of the same name, last week launched Riffsy, a free iPhone and iPad app that it claims brings together the best features of animated GIFs with social sharing options. The app finds short, repeating video clips, or Riffsys, and lets you share them with your friends. It also has an online editing tool that easily creates Riffsys from online videos.

    To be clear: Riffsy isn?t powered by animated GIFs; it?s just replicating the looping clips we?ve grown to love from that format. Riffsy?s clips are actually fast-loading streaming videos on the web and mobile (although they do get transcoded to animated GIFs for e-mail).

    The immediate appeal of Riffsy isn?t hard to explain. It?s easy to get mesmerized with all the short clips, and the app encourages you to share the clips across iMessage, e-mail, Twitter, and Facebook.? It?s well positioned to be a go-to service for self expression with your friends.

    But Riffsy?s true genius is a bit more subtle: The clips typically link back to an original video, which could be something on YouTube or a purchase page on Amazon.

    By tapping into the magic of the addictive yet seemingly immature animated GIF (something that the mobile video sharing app Vine also takes advantage of), Riffsy could give content makers the best way yet to advertise their content on the web. It?s also easy to see how Riffsy?s technology could spice up video discovery for services like YouTube and Netflix (imagine a YouTube homepage alive with choice clips or a Netflix page showing off choice scenes from movie trailers).

    ?In our view, the biggest problem with video discovery was that the actual process of discovery was really shitty,? said David McIntosh, Redux?s president and founder, in an interview with VentureBeat. ?Our solution was to let content creators take a premium piece of content and create a riff on that.?

    Indeed, Riffsy?s current progress shows McIntosh has tapped into something powerful: The short clips have been viewed 20 million times in Riffsy?s first three weeks online. McIntosh says 93 percent of people using the Riffsy iPhone app are sharing videos through iMessage, while only 6 percent are sharing with Facebook.

    Before launching the iPhone app last week, Riffsy was also a part of the launch campaigns for Arrested Development?s new season on Netflix and Dexter?s latest season on Showtime. For Arrested Development, Riffsy generated more than a million views and tens of thousands of clicks back to Netfix?s landing page for the show in the first day of its campaign. It?s easy to imagine how Riffsy can grow as more properties use it.

    Using short flash videos in ads is nothing new for media companies, but Riffsy opens up the potential for fans to actually share clips, which their friends will likely pay more attention to than a typical banner ad.

    McIntosh tells me that Redux will soon implement Riffsy?s technology in its video discovery apps, which are now available on more than 100 million connected devices, including Google TV and the PlayStation 3. He?s also looking to bring Riffsy to the company?s television network partners.

    So if your cable network?s channel guide all of a sudden feels more alive with dynamic short clips, you?ll likely have Riffsy to thank.

    Chromecast, Google's $35 TV Solution, Now Available

    Google introduced a new Nexus 7 and Chromecast, a $35 phone- and tablet-controlled dongle that directs content to your television.

    Google yesterday introduced an improved Nexus 7 (yes, the company's still calling it the Nexus 7), along with Chromecast, a $35 dongle that puts new convenience, and Google, into the television-viewing experience. Chromecast plugs into the High Definition Multimedia Interface (HDMI) slot on an HDTV, enabling users to direct video content to the TV via a smartphone, tablet or PC, whether it's running an operating system from Google, Apple or Microsoft. Plus, while the phone is busy "casting," it can still be used for other things, like emailing. Chromecast works with Netflix, YouTube, Google Play Movies & TV, Google Play Music and, soon, more apps, like Pandora. Content is cast from the cloud to the TV?a user's smartphone or tablet essentially becomes the remote control making this happen. "It just automatically works," said Sundar Pichai, Google's senior vice president of Android and Chrome, introducing the device at a July 24 media event in San Francisco. At the event, Google also introduced a Cast software development kit (SDK) to help developers build "intuitive multi-screen experiences across mobile devices and TVs," as it said in a July 24 blog post. In a fast-growing, increasingly complex market in which Amazon and Netflix are now developing original "television" content, Chromecast is an extremely affordable way in which Google can keep its brand, its hardware and its Google Play app store in the mix. (During the event, it also announced that it is making it easier to discover tablet-specific apps in Play.) Apple currently offers the $99 Apple TV, which enables users to watch content on their television from iOS devices, as well as from iTunes and content sources such as Netflix, Hulu Plus, YouTube and Vimeo. It recently made major updates to Apple TV with content from, among other sources, HBO Go and WatchESPN. It's been widely rumored, of course, that Apple is also developing a television. Piper Jaffray analyst Gene Munster has reported that it's likely to come with a display between 42 and 55 inches and be priced between $1,500 and $2,000, making it an aspirational purchase, versus the no-brainer, for some, of Chromecast. "I just bought two. One for home, one for travel and hotels," a commenter wrote beneath the Google blog post.

    As for Google's other new hardware, the Nexus 7, said Pinchai, now accounts for more than 10 percent of the Android tablets sold. The new model, like the original, is made by Asus, and is 2mm thinner and 50 grams lighter. The display is still 7 inches on the diagonal, but Asus has packed in more pixels, bumping up the resolution to 1920 by 1200, making it the highest-resolution 7-incher on the market. It's the first device to run Android 4.3, which includes new access limits, so parents can protect kids from inappropriate content, as well as limit in-app purchases. There's a front-facing 1.2-megapixel camera, a 5-megapixel camera on the back, dual stereo speakers, a 1.5GHz Snapdragon processor and wireless charging. Chromecast is available now, from Google Play, Amazon and BestBuy.com. The Nexus 7 will go on sale July 30 in the Play store and a handful of other outlets, including Walmart, Staples and Gamestop. It's available to preorder today from Best Buy, for $229 for a 16GB WiFi-only version or $269.99 for 32GB. There'll also be a model with 4G LTE connectivity from T-Mobile and Verizon Wireless. With the Nexux 7, said Pinchai, Google is working with partners to "push the boundaries of what's possible."

    VerticalResponse Email Marketing Company Acquired by Deluxe

    Customers of VerticalResponse, the email marketing software company, received a surprise email yesterday announcing that the company had been acquired by Deluxe Corporation. ?The purchase price ?was $27 million in cash.

    The news also was officially reported in the Deluxe Corporation earnings release.

    In that release, Deluxe reported revenue of $381 million, with net income (profit) of $48 million for the second quarter.?About two-thirds of the revenue came from what Deluxe calls ?small business services.? ?And that?s where the acquisition of VerticalResponse fits in.

    In a statement accompanying the earnings release, Lee Schram, CEO of Deluxe, said, ?Revenue in the second quarter was at the upper end of our outlook ? driven by favorable performance particularly in both Small Business Services and Financial Services. Marketing solutions and other services revenue grew 21% over last year and will further benefit from the acquisition of VerticalResponse. Our strong first half of the year positions us well to grow revenue in 2013 for a fourth consecutive year.?

    The acquisition took place in June 2013, although just now reported. ?VerticalResponse will continue to be based in San Francisco, its current headquarters.

    Deluxe, which many people still think of as the check printing company, has been transforming itself to a small business services provider in recent years, largely through targeted acquisitions. Since 2008 it has bought Web hosting company Hostopia, startup community website PartnerUp, Internet marketing company OrangeSoda, and logo company Logomojo.

    The founder of Vertical Response, Janine Popick, wrote on that company?s blog that VerticalResponse had been in numerous acquisition talks over the years. ?Deluxe was the company that offered the best fit:

    ?Over the course of 12 years we?ve had many conversations, and I mean?many. Companies big and small, public and private, too many to even think about. And every time we walked away from a conversation it was because the company didn?t value us for our abilities and wouldn?t have given our shareholders what they deserve.?But this one was different. It was great, it was time and it was?perfect.?

    In addition to email marketing, VerticalResponse has broadened its offerings into related areas, including online surveys and marketing postcards. ?In late 2011 it acquired social media platform Roost to expand into social media marketing.

    According to Popick, one of the things that will change is that more resources can now be placed on product development.

    When we spoke with VerticalResponse in late 2011, the company reported 100,000 customers, plus 30,000 brought by the acquisition of Roost. ?VerticalResponse?s website today says the company has 800,000 users worldwide ? but users and customers are not the same.

    VerticalResponse employs 110 employees. ?Deluxe is headquartered in St. Paul, Minnesota.

    Eco-friendly NYK Coal Carrier Honored as 2012 Ship of the Year

    Soyo, an NYK-owned coal carrier, has been selected as the 2012 ?Ship of the Year? by the Japan Society of Naval Architects and Ocean Engineers (JASNAOE). An awards ceremony was held on July 25, and Mitsuhiko Sunouchi, the general manager of NYK?s Technical Group was presented with the recognition by JASNAOE.

    JASNAOE?s ?Ship of the Year? award has been presented every year since 1990 to a Japan-built vessel that the society considers to be the most technically advanced, well-designed, and socially conscious. The NYK Group?s cruise ship Crystal Harmony (current name: Asuka II) received the society?s first ?Ship of the Year? award in 1990, and NYK-Hinode Line Ltd.?s two module carriers Yamatai and Yamato were recognized with special awards in 2010.

    Soyo was honored for its innovative air-lubrication system and its proven impact on CO2 reduction. This new air-lubrication system reduces CO2 emissions by taking some of the main engine scavenging air (combustion air) from the main engine?s turbocharger and leading it to the vessel?s bottom to reduce the frictional resistance between the vessel?s bottom and the seawater. A system featuring this scavenging air bypass is expected to be effective in reducing CO2 on large vessels having deep drafts.

    Yamatai and Yamato have similar air-lubrication systems, and were actually the world?s first vessels involved in overseas transport to have such a system permanently installed. The NYK Group is currently looking to equip car carriers with this eco-friendly system.

    The system was jointly developed by NYK, Oshima Shipbuilding Co. Ltd., and the Monohakobi Technology Institute, an NYK Group company, in cooperation with the National Maritime Research Institute. System development was subsidized through Japan?s Ministry of Land, Infrastructure, Transport and Tourism?s ?Support for Technology Development from Marine Vessels for Curtailing CO2? project, among others.

    The NYK Group will continue to encourage initiatives that address climate change by striving to install this system on other types of vessels.

    Detroit manager scores first win over unions in bankruptcy bid

    DETROIT (Reuters) - A U.S. bankruptcy court judge on Wednesday dealt a blow to Detroit's public employee unions and pension funds opposed to the city's historic bankruptcy filing by suspending legal challenges in Michigan state courts while he reviews the city's petition for protection from creditors.

    Judge Steven Rhodes ordered three lawsuits filed by city workers, retirees and pension funds be halted and extended that stay to suits against Michigan's governor, treasurer and Detroit's emergency manager. Rhodes' action ensures that the only path to fight the city's Chapter 9 bankruptcy petition runs through his courtroom in downtown Detroit.

    It also sets the stage for what is expected to be a protracted and bruising battle over the city's eligibility to restructure more than $18 billion in debt and pension and healthcare liabilities under the broad protections of federal bankruptcy law.

    "It gives us one venue to settle our disputes. This brings it into one court where it should be," said Bill Nowling, a spokesman for Detroit Emergency Manager Kevyn Orr, who attended the oral arguments before Rhodes on Wednesday morning but did not return for the judge's ruling from the bench in the afternoon.

    The city's unions and pension funds had hoped to keep the fight in state court, where they felt Michigan's constitutional protections of retiree benefits would prevail against efforts by Orr to scale them back. Now, barring an appeal of the Rhodes ruling, their fight likely turns to convincing the judge that Orr has not dealt with them in good faith in negotiations since he was appointed by state officials in March.

    "Stay or no stay, we will never stop fighting for Detroit and its workers," Al Garrett, president of American Federation of State, County and Municipal Employees Council 25, Detroit's biggest union, said in a statement.

    Union members in the packed courtroom held their heads in their hands or shook their heads as Rhodes ruled against them on all three of the motions at issue in the day's proceedings. Meanwhile, city firefighters, worried that the bankruptcy case will lead to stinging cuts in their retirement benefits, protested outside.

    Ironically, Wednesday's launch of the bankruptcy case began exactly 312 years after the settlement that became Detroit was founded in 1701 by French soldier Antoine de la Mothe Cadillac, after whom the iconic Cadillac automobile brand was named when the city grew to be the cradle of the U.S. automotive industry.

    Detroit, which also gave birth to the music industry's Motown sound in the 1960s, has struggled for decades as companies moved or closed, crime became rampant and its population shriveled by almost two-thirds since the 1950s to about 700,000 at present. The city's revenue failed to keep pace with spending, leading to years of budget deficits and a dependence on borrowing to stay afloat.

    PROVE INSOLVENCY, GOOD FAITH

    The immediate next step in the case now is a procedural hearing before Rhodes set for August 2. At some point after that, Rhodes will preside over formal hearings to determine whether Detroit is eligible to declare bankruptcy. The city's Chapter 9 municipal bankruptcy petition is the largest in U.S. history.

    The next phase of the case involves the city proving that it is insolvent. The city will also have to prove it made a good-faith effort to negotiate with its creditors or that there are too many creditors to make negotiating possible.

    In his initial court filing last week, Orr said the pool of potential creditors, including current city workers, retirees, and bondholders, is vast and it would have been essentially impossible to negotiate with each of them outside of the Chapter 9 process.

    In a signal that the judge is going to press both sides into hard negotiations, Rhodes has proposed the appointment of a federal judge as mediator in the case.

    Gerald Rosen, chief judge for the U.S. District Court for the Eastern District of Michigan, can direct parties in the case to mediate and designate other mediators, according to the proposed order, which also said information from the mediation sessions would not be disclosed or placed in evidence. Rosen's appointment will be at issue during the August 2 hearing.

    Detroit has more than $18 billion of debt and unfunded liabilities it is seeking to restructure, some at rates as low as pennies on the dollar, according to Orr's preliminary offer to creditors last month. Roughly half its liabilities stem from retirement benefits, including $5.7 billion in liabilities for healthcare and other retiree benefits and a $3.5 billion pension liability.

    Orr wants to wrap up the city's bankruptcy case by September 2014, but the process for determining a municipality's eligibility for bankruptcy, which in Detroit's case may involve arguments concerning the state constitutionality of the filing, could drag on. In Stockton, California's case, it took almost a year.

    El Paso City Council votes to deny former mayor's $700,000 legal claim

    Former Mayor John Cook's claim that the city should pay his $550,000 legal bill that stemmed from fighting a recall effort was unanimously denied by the City Council on Tuesday.

    In a prepared statement, the city said that Cook initiated a suit tied to his recall as an individual and not an elected official, and that city had not approved the litigation.

    "The council's decision turned on multiple factors, including the fact that Cook initiated this suit in his individual capacity, that the litigation was not authorized by the city, and the underlying litigation is still pending," the statement reads.

    City officials would not comment further on Tuesday and said it's a legal matter they can't discuss. With the council rejecting his claim, Cook now has the option to fight the decision through a lawsuit.

    After the vote, Cook said he would take time to consider whether to sue the city and added that he believes he has a valid claim.

    "I stood alone on this issue from day one," said Cook, who last week put his legal bills at about $700,000. "It doesn't seem like anybody in the city of El Paso thought the election codes were important to us, which is why I had to stand alone

    and file my lawsuit."

    Cook fought the recall and took Bishop Tom Brown and Word of Life Church to court claiming Brown violated the law by circulating recall petitions in the church. The 8th Court of Appeals agreed, but the matter remains tied up in the courts. The process has lasted more than two years.

    Cook claims that city lawyers gave the council bad advice when they okayed holding a referendum election spurred by a petition led by Brown and other religious conservatives. Voters did away with health benefits for domestic partners. Cook broke a tie and voted to restore them.

    That advice, Cook claims, goes against arguments that the city made to fight one of the petitions that attempted to stop the demolition of the former City Hall building.

    City attorneys have argued that the charter does not allow for a vote of the people to reverse actions already taken by the council, and that it only provides citizens a process to initiate new legislation. At issue has been whether the partner benefits

    question that went to voters was a referendum or an initiative, which refers to original legislation. The City Charter allows referendums, which overturn ordinances approved by council, only in collective bargaining agreements.

    "Neither Mr. Cook's assertion that the November 2010 referendum was improper nor his success in enjoining illegal corporate campaign activity entitles him to payment of his attorney's fees," the city statement reads. "Fortunately for Mr. Cook, if he prevails in the pending case, he will be able to ask the trial court to order that his fees be paid by those found to have harmed him."

    In April, Cook made then withdrew a similar request to council and said he needed more time to prepare his arguments.

    Cook, 67, left office last month. He was ineligible to run for re-election because of term limits.

    The Nayara Suite was not your average room ? it was a spacious octagonal casita-like suite with a bathroom substantially bigger than my living room at home. ?We had his and hers sinks across the room, ample closet space, a double shower inside and a double outside shower inside a walled-in garden.

    The deck?..oh my goodness the deck?..it?s where we spent the majority of our time!! ?The deck felt as if it were in the middle of a secluded rainforest. ?On our large wrap-around deck, we had a woven hammock, two adirondack chairs, a table and chairs and an outside jacuzzi. ?All of this had a spectacular view of the Volcano! ?I felt as if I could reach out and touch it!

    The service was impeccable. ?Travel and Leisure named it as having the 8th best service in the world for Resorts, Inns and Lodges. ?It was second in Central and South America?just 0.49 points away from the top hotel, the fabulous Explora Patagonia. ?The staff is friendly and helpful ? greeting guests in that warm Tico style.

    Bella Travel Arenal VolcanoBreakfast every day was a delight ? I ate my weight in fruit and Costa Rican fare. ?The main dining area was surrounded by flowers and overlooked Arenal.

    The small pool offered a swim up bar and cozy pool pod-like chairs. ?At the pool are three independent whirlpool jacuzzi tubs. ?The pool was my favorite place to unwind after a day of adventure!

    Walking through the resort was like walking through a large garden. ?Secluded scenic palapas with comfy hammocks were strewn throughout the resort.

    The spa area felt as if we had been transported to the middle of the jungle. ?The man and I had one of the best couples massages we had ever experienced! ?My massage therapist worked out every knot in my body?wonderful after a day of rappelling down waterfalls!

    Although the hotel was almost at full capacity, we felt at times like we were the only ones there.

    Any stay in the interior of Costa Rica would not be complete without a stay at Nayara?..and I highly recommend the Nayara Suite. ?Trust me, you will not want to come back home!
